Oregon’s Cannabis Laws (2025): What You Need to Know

Medical marijuana has been legal in Oregon since 1998. In 2014, voters approved Measure 91, allowing adults 21+ to purchase and possess marijuana for personal use.

  • The Oregon Health Authority (OHA) oversees the medical program.

  • The Oregon Liquor & Cannabis Commission (OLCC) regulates adult-use/recreational businesses.

Whether you are a patient, caregiver, or business owner, staying compliant with Oregon law is essential. Below are the key rules at a glance.


Medical Marijuana Patient Rights

Qualified patients and caregivers may possess:

  • 6 mature plants at a registered grow site

  • 24 ounces usable marijuana

  • 16 oz solid or 72 oz liquid cannabinoid products

  • 16 oz concentrate or 5 g extract (inhalants included)

  • 4 immature plants + 50 seeds


Recreational Use (Adults 21+)

  • Public possession: Up to 1 oz usable marijuana

  • Private possession: Up to 8 oz usable marijuana

  • Seeds/plants: Up to 4 immature plants + 10 seeds per household

  • Concentrates/extracts: Up to 5 g

  • Edibles: Up to 16 oz solid or 72 oz liquid

⚠️ Use is limited to private property. Smoking or vaping in public spaces (streets, parks, apartments, hotels, buses, etc.) is prohibited.


Packaging & Labeling (OLCC Regulated)

  • All cannabis products must have approved packaging and child-resistant containers.

  • Labels must include warnings, potency, serving sizes, and contents.

  • Custom labels require OLCC approval before sale.


Qualifying Conditions for a Medical Card

Conditions that may qualify:

  • Chronic severe pain, chronic nausea, PTSD
  • AIDS/HIV, cancer, glaucoma, hepatiti
  • Chronic muscle spasms, multiple sclerosis, arthritis, asthm
  • Seizure disorders (e.g., epilepsy), Parkinson’s Disease, cachexi
  • Gastrointestinal disorders (e.g., IBS, Crohn’s disease, inability to eat), GER
  • Side effects from other medical treatments causing these symptoms
  •  

Process: Proof of Oregon residency, physician documentation, and an application to the Oregon Medical Marijuana Program (OMMP). Patients receive a temporary card while waiting for the official one.


Delivery

  • Only OLCC-licensed retailers (or their representatives) may deliver cannabis.

  • Drivers must be registered in the Cannabis Tracking System (CTS) with a valid worker permit.

  • Deliveries must be made to a consumer’s residence (not schools or public places).


Data Privacy

  • Retailers cannot record or retain personal information from cannabis sales.

  • Exceptions apply only if a customer gives consent for marketing communications.

  • Data cannot be transferred or sold.


Taxes

  • Recreational sales: 17% state excise tax + up to 3% local tax

  • Medical sales: Not taxed

  • Discounts and promotions are restricted (no “BOGO” deals; loyalty points apply only to accessories).
